These Terms of Service ("Terms") govern your use of the hosting services provided by HostMyService ("we", "us", "our"), including Discord bot hosting (HostMyBot), game servers, monitoring, backups and related add-ons (the "Services"). By ordering or using the Services you agree to these Terms.
1. Who we are
HostMyService is a hosting provider operated from the Netherlands. Contact: support@hostmyservice.net, or a ticket on our Discord. HostMyBot is a service of HostMyService.
2. The Services
We provide shared-node hosting for Discord bots, game servers (such as ETS2/ATS), monitoring (Uptime Kuma and SmokePing), offsite backups and optional upgrades and add-ons, as described on our website. Some items are marked "soon" and are not yet available. We aim for high availability but do not guarantee uninterrupted, error-free service.
3. Ordering and account access
There is no automated checkout on our website. You build your order and confirm it with us through a Discord ticket; we then confirm the final price and payment details and set up your service. Accounts on the client panel are created by us. You are responsible for keeping your login credentials secure and for all activity under your account.
4. Fees and payment
- Prices are shown on our website and may be billed monthly, quarterly, half-yearly or annually; longer cycles are cheaper per month. Your whole order is billed together on one invoice.
- Prices shown may still change; the price we confirm in your ticket is the price that applies to your order.
- No VAT is applied to the prices shown.
- Services renew for the chosen cycle until cancelled. Payment is due as agreed at the time of order.
5. Acceptable use
You must not use the Services to:
- Store or distribute illegal, infringing or offensive material.
- Conduct DDoS attacks, spam, phishing or other cybercriminal activity.
- Host malware, ransomware or other malicious software.
- Abuse shared resources, evade limits, or run workloads that endanger other users or our infrastructure.
We may suspend or terminate Services immediately for a serious breach, without prior notice.
6. Your responsibilities
You are responsible for your own bots, servers, content and configuration, for complying with applicable laws and third-party terms (including Discord's Terms of Service), and for keeping your own backups. While we offer backup options, you remain responsible for your data.
7. Term, cancellation and data retention
You may cancel at any time via a Discord ticket; cancellation takes effect at the end of your current billing cycle unless agreed otherwise. See our Refund & Cancellation Policy for refunds. After a service ends or expires, we may permanently delete the associated server and data to free resources; we recommend downloading anything you need beforehand.
8. Liability
To the extent permitted by law, our liability is limited to direct damage caused by intent or gross negligence, up to the amount you paid for the Service in the three months before the event. We are not liable for indirect damage, loss of profit or data loss.
9. Privacy
We process personal data in line with our Privacy Policy.
10. Minimum age
You must be at least 13 years old (and meet Discord's minimum age) to use the Services; if you are under the age of majority in your country, you need the consent of a parent or guardian.
11. Changes to these Terms
We may amend these Terms. Material changes will be announced via Discord or e-mail in advance where reasonably possible; the "last updated" date shows the current version.
12. Governing law
These Terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer rights you may have.
